These Terms & Conditions apply to services provided by Miroslava Sakacova trading as Web & Why ("we", "us", "our").
By engaging our services, you agree to these terms.
Web & Why provides website, UX, consumer psychology, customer experience and conversion optimization services, including website reviews, audits, strategic recommendations and optimization services.
The specific scope of work, deliverables, timescales and fees will be agreed before work begins.
You agree to provide accurate and relevant information reasonably required for us to complete the agreed work.
You are responsible for decisions made and changes implemented following our recommendations.
Fees will be agreed before work begins.
Unless otherwise agreed, payment is required before work commences.
All prices will be stated in GBP and will specify whether VAT is included where applicable.
We reserve the right to suspend or withhold delivery where payment is overdue.
If you cancel a project after work has commenced, fees may not be refundable for work already completed.
If you cancel before work begins, any refund will be handled according to the individual agreement and applicable law.
Once all agreed fees have been paid, materials created specifically for your project are provided for your business's use, unless otherwise agreed in writing.
We retain ownership of our underlying methodologies, frameworks, processes, templates and know-how.
We will treat confidential business information you provide to us as confidential and will not knowingly disclose it to third parties except where necessary to provide the agreed service or where required by law.
Where a project involves third-party services or platforms, we are not responsible for outages, changes, errors or failures caused by those third parties.
Our recommendations are designed to identify opportunities to improve your website and customer experience. We do not guarantee specific increases in sales, enquiries, conversions, revenue or other business results.
We will provide our services with reasonable care and skill.
To the extent permitted by law, we are not liable for indirect or consequential losses, loss of profits, loss of revenue, loss of data or business interruption arising from the use or implementation of our recommendations.
Nothing in these Terms limits or excludes liability that cannot legally be limited or excluded.
We may update these Terms & Conditions from time to time.
The version applicable to a project will normally be the version in effect when the relevant agreement is made, unless otherwise required by law.
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes will be subject to the jurisdiction of the courts of England and Wales.
